Terms of Service
These terms govern your use of Offcut. By using Offcut, you agree to them. Please read them — especially the sections on how transactions work and the limits of our responsibility.
1.What Offcut is
Offcut is a venue that connects construction professionals so they can buy, sell, rent, and offer surplus materials, equipment, and services. Offcut provides the platform and messaging; that's it.
Offcut is not a party to any transaction between users. We do not own, sell, buy, inspect, store, guarantee, or deliver any item or service listed. We are not involved in payment — buyers and sellers arrange payment and exchange directly between themselves. Any deal is solely between the users involved.
2.Eligibility
You must be at least 18 years old and using Offcut for legitimate business purposes. If you use Offcut on behalf of a company, you represent that you're authorized to do so.
3.Your account
Provide accurate information and keep it up to date. You're responsible for activity under your account and for keeping your login secure.
4.Listings and conduct
You are responsible for what you post and do on Offcut. You agree that you will:
- Post accurate, honest listings for items or services you have the right to offer.
- Comply with all applicable laws, licensing, permitting, and safety requirements.
- Not list prohibited or unsafe items — including hazardous or regulated materials (such as asbestos-containing materials or contaminated fill), stolen goods, counterfeit or recalled products, or anything illegal.
- Not harass, defraud, spam, or endanger other users.
We may remove listings or suspend accounts that violate these terms, at our discretion.
5.Transactions and payment
All payment and exchange happen directly between users, off-platform. Offcut charges no transaction fee and has no role in payment. You are responsible for negotiating your own deals, inspecting items, arranging pickup or delivery, and handling your own taxes and compliance.
6.Messaging
Keep communication on Offcut and respectful. Don't use messaging to spam, harass, or solicit off-platform payment scams. We may review messages when needed for safety, moderation, or legal reasons.
7.Verification and reviews
A "Verified" badge or user reviews are provided as a convenience and are not a guarantee of any user, their licensing, or the quality or safety of anything they offer. Always do your own due diligence and meet safely.
8.No warranty
Offcut is provided "as is" and "as available," without warranties of any kind. We do not guarantee the accuracy of listings, the conduct of users, or the quality, safety, or legality of any item or service.
9.Limitation of liability
To the fullest extent permitted by law, Offcut and its owners are not liable for any indirect, incidental, or consequential damages, or for disputes, losses, injuries, or damages arising from transactions or interactions between users. Offcut's total liability for any claim relating to the service is limited to the amount you paid us to use it (which, for a free service, is zero).
10.Indemnification
You agree to indemnify and hold Offcut harmless from claims arising out of your listings, your transactions with other users, or your violation of these terms or the law.
11.Your content
You keep ownership of the content you post. You grant Offcut a license to host and display that content as needed to operate and promote the service.
12.Termination
You may stop using Offcut at any time. We may suspend or terminate accounts that violate these terms or create risk for other users.
13.Changes to these terms
We may update these terms as Offcut grows. We'll update the "Last updated" date and, for significant changes, provide additional notice. Continuing to use Offcut means you accept the updated terms.
14.Governing law
These terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules.
